Anozilla's Adoptable ToS

Hello! This is a quick, simple carrd for my Adoptable-specific ToS I could not fit elsewhere (yet).

My Terms of Service here talk about "You", the buyer, as if you already have purchased the rights to the adoptable. These rules only are in place once the character has been transferred.

General Rules

  • You may change the adoptable's design, species and assign them a gender to your heart's content. You may name them, humanize them, port them into existing closed/open species, etc.

  • If you wish to create an all-new open / closed species based on one of my adoptables, please reach out first. This falls into 'commercial use' and is not something I allow without prior communication.

  • Once the character leaves my hands, you may do as please with them. Please note, I do not monitor what people do with designs they get from me. It is none of my business. However, if you create content I personally find uncomfortable, I behold the right to block you & move on.

  • Do not sell an adoptable for more than you got them for unless they come with extra art attached. I will block those who "flip" my designs (buying them and then reselling for a higher price without any sort of extras attached). Reselling a traded design is up to your discretion.

  • I do not allow/consent to gift and free-to-enter raffle designs I create being resold or retraded unless extra art is added on. If you do not want one of my designs anymore you have acquired for free, you can reach out about giving it back, or re-gifting or re-raffling it. [ Adding additional art does allow you to re-sell however. ]

  • Do not heavily edit my artwork and if you do make edits, please credit them accordingly. Edits such as adding small markings, or editing the eye color are fine. Anything more than that I ask people please create their own artwork as a reference.

  • Do not Hue-shift my artwork/design. Please draw your own reference for heavy design changes, as stated above!

  • My Watermark should stay completely untouched. Do not move, remove or edit my watermark in any way.

Should any of these ToS be broken after acquiring a design or an adoptable from me, the consequence will generally be a block. No design rights will be revoked at any point. The only exception to that being a fraudulent chargeback/scam. [ E.g. I sell an adoptable and wake up to a chargeback on Paypal. That's a scam. ] In which case I behold the right to 'revoke' the rights to the character and permanently 'void' it. [ Will not be re-sold again. ]

Payment

  • All purchases are, unless explicitly stated otherwise, purely digital. No items will be shipped as there are no physical items.

  • All purchases are final, I will never accept refunds for adoptables. You are allowed to re-sell my adoptables for their original worth / added worth. Fraudulent chargebacks (scams) will be met with a public client beware, permanent block&blacklist aswell as me beholding my right to revoke the character's rights, permanently 'voiding' them, or using them for personal use. [ They will not be re-sold or re-traded again. ]

  • Currency Payment will be done through PayPal exclusively.

  • Haggling is not welcome. My prices are firm.

  • The character / unwatermarked files will be sent once full payment has been received.

  • Holds are reserved for trusted/repeat buyers. This is not out of favoritism, but because I have been ghosted with almost every hold I've done for a complete stranger. Once you've bought from me successfully, you may ask about holding adoptables for you.

  • Holds may not be longer than 3 days. I will send one reminder after the agreed upon deadline. If there is no response within 24 hours, the adoptable will automatically go back up for sale.

Response times & Ghosting

  • Failure to send Payment within a 48 hour timeframe will cause in the adoptable to go back up for sale. By "Claim"ing an adoptable, you agree to this timeframe.

  • Someone failing to send payment / ghosting me more than once will be blocked.

Commercial Rights

Commercial rights are the rights to use a design for things that generate income for the person using them.
Examples: Creating prints of a character and selling those, or creating a pre-made Fursuit adoptable based on my design and then selling the fursuit with rights to the character.No, you don't need commercial rights just to use your OC, or use them as a sona, or even a Mascot! Same with Desktop backgrounds or using them as your icon on social media.
This is only applicable if you plan to print merch of them or otherwise use their design explicitly for profit.

  • My adoptables and art do not automatically come with commercial rights.

  • Commercial rights to adoptables / designs may usually speaking be purchased for a +100% price fee. [ E.g. If an adoptable is $50, it will cost an extra $50 for the commercial rights to them. ] This however can depend based on the design in question and whether it was a flatsale or an Auction. It will always be clearly stated how much commercial rights are and if you are unsure, simply ask/reach out.

  • The original artwork an adoptable comes with is unobtainable for commercial rights. My adoptable artworks are not created for prints and similar things and as such may not result in a level of quality I would be fine with being put out there under my name. Obtaining commercial rights to my adoptables / designs is exclusive to the designs themselves. My regular art can be purchased for commercial rights so long as I'm given a heads up.

  • In terms of wanting to make a closed species based around one of my one-off adoptables, again, please reach out to me privately about those matters.
